Per aix\u00f2, fins fa poc, si el treballador no feia hores extraordin\u00e0ries, l&#8217;empresa no estava obligada a computar la jornada di\u00e0ria de dit empleat.\u00a0<!--more--><\/p>\n<p>No obstant aix\u00f2, en aquests dos \u00faltims anys s&#8217;han produ\u00eft <strong> tres sent\u00e8ncies de l&#8217;Audi\u00e8ncia Nacional <\/strong>-del 4 desembre 2015<strong> (<strong> cas Bankia );<\/strong><\/strong> del 19 de febrer de 2016<strong><strong> (<strong> cas Abanca\u00a0)<\/strong><\/strong><\/strong> i del 5 de maig de 2016<strong><strong><strong> (<strong> cas Banc Sabadell ) <\/strong><\/strong><\/strong><\/strong>&#8211; que indiquen que les empreses estan obligades a registrar la jornada di\u00e0ria de seus treballadors sempre<strong><strong><strong><strong>, <span style=\"text-decoration: underline;\"> <strong> encara que no es facin hores extraordin\u00e0ries. <\/strong><\/span><\/strong><\/strong><\/strong><\/strong><\/p>\n<p>La justificaci\u00f3 del tribunal \u00e9s que el registre <strong> diari \u00e9s un requisit imprescindible per controlar els excessos de jornada. <\/strong><\/p>\n<p>La manca del corresponent registre pot ser sancionat amb multa, en el grau m\u00ednim, de <strong> 626 <strong> a 1.250 euros , en el grau mitj\u00e0 de <strong> 1251-3125 euros ; i en el grau m\u00e0xim de <strong> 3126-6250 euros .<\/strong><\/strong><\/strong><\/strong><\/p>\n<h2><\/h2>\n<h2>Els treballadors a temps parcial s&#8217;inclouen en els registres de jornada diaris?<\/h2>\n<p>Els registres de jornada hauran de ser diari, amb la finalitat de determinar les hores efectivament realitzades cada dia per cada treballador. Ha d&#8217;indicar l&#8217;hora d&#8217;incorporaci\u00f3 i finalitzaci\u00f3 de la jornada de treball i les pauses si les hagu\u00e9s (hora menjar migdia &#8230; ect)<\/p>\n<p><span style=\"text-decoration: underline;\"> <strong> Als treballadors a temps parcial , <span style=\"text-decoration: underline;\"> en cas d&#8217;inexist\u00e8ncia del registre horari de jornada es presumeix que el contracte celebrat ho \u00e9s a <strong> jornada completa , excepte prova en contra que acrediti el car\u00e0cter parcial dels serveis.<\/strong><\/span><\/strong><\/span><\/p>\n<p>El registre s&#8217;ha de fer dia a dia i es totalitzar\u00e0 mensualment, lliurant c\u00f2pia del resum al treballador.<\/p>\n<p>L&#8217;empresari ha de conservar els resums mensuals dels registres de jornada diaris durant un per\u00edode m\u00ednim de <strong> quatre anys. <\/strong><\/p>\n<p>La comprovaci\u00f3 de l&#8217;exist\u00e8ncia dels registres de jornada diaris s&#8217;ha de poder fer en el centre de treball, i no \u00e9s acceptable l&#8217;al\u00b7legaci\u00f3 de l&#8217;empresari de la seva acreditaci\u00f3 posterior a compareixen\u00e7a en depend\u00e8ncies administratives<\/p>\n<p>&nbsp;<\/p>\n<h2>Com he d&#8217;emplenar els registres de jornada diaris?<\/h2>\n<p>El model o tipus de registre \u00e9s lliure (manuals, electr\u00f2nics o inform\u00e0tics), per\u00f2, ha de ser un sistema de registre que garanteixi la fiabilitat i la invariabilitat de les dades.<\/p>\n<p>En cas de registre manual de jornada \u00e9s imprescindible de la signatura di\u00e0ria del treballador.<\/p>\n<p>A nivell inform\u00e0tic en el mercat hi ha abundant programari de gesti\u00f3 on els treballadors poden signar digitalment de forma remota mitjan\u00e7ant Smatphone, Tablet, Portatil &#8230; ect.<\/p>\n<span class='highlight'> * Aquesta not\u00edcia cont\u00e9 informaci\u00f3 de car\u00e0cter general, sense que constitueixi opini\u00f3 professional ni assessoria jur\u00eddica i fiscal.
