{"id":2873,"date":"2018-01-19T09:00:53","date_gmt":"2018-01-19T09:00:53","guid":{"rendered":"https:\/\/www.santcugatconsulting.com\/reclamacion-clausula-suelo-hipoteca\/"},"modified":"2018-01-18T13:09:28","modified_gmt":"2018-01-18T13:09:28","slug":"reclamacio-clausula-sol-hipoteca","status":"publish","type":"post","link":"https:\/\/santcugatconsulting.com\/ca\/reclamacio-clausula-sol-hipoteca\/","title":{"rendered":"Cl\u00e0usula s\u00f2l: Com reclamar la seva nul\u00b7litat"},"content":{"rendered":"<p>En aquesta entrada ens agradaria aclarir alguns dubtes que encara queden respecte a qui, qu\u00e8 i com s&#8217;ha de realitzar la reclamaci\u00f3 de la <strong> cl\u00e0usula s\u00f2l de la hipoteca.\u00a0<\/strong><!--more--><\/p>\n<h3>En quins casos puc reclamar la nul\u00b7litat de la cl\u00e0usula s\u00f2l de la meva hipoteca?<\/h3>\n<ul>\n<li>A partir de la Sent\u00e8ncia de 9 de maig de 2013 del <a href=\"http:\/\/www.poderjudicial.es\/cgpj\/es\/Poder-Judicial\/Tribunal-Supremo\/\"> Tribunal Suprem <\/a> , s&#8217;obre la possibilitat de reclamar judicialment amb probabilitat d&#8217;\u00e8xit, <strong> la nul\u00b7litat de les cl\u00e0usules s\u00f2l dels cr\u00e8dits hipotecaris, en el cas que <strong> no hagu\u00e9s conegut , haguessin estat emmascarades amb un altre tipus d&#8217;informacions, i <strong> no haguessin estat transparents.<\/strong><\/strong><\/strong><\/li>\n<li>Es considera per l&#8217;Alt Tribunal que no han estat transparents en la referida sent\u00e8ncia perqu\u00e8 <strong> falta informaci\u00f3 prou clara que es tracta d&#8217;un element definitori del contracte,<\/strong> s&#8217;insereixen de manera conjunta amb les cl\u00e0usules sostre i com aparent contraprestaci\u00f3 de les mateixes, no hi ha simulacions d&#8217;escenaris diversos amb el comportament raonablement previsible del tipus d&#8217;inter\u00e8s en el moment de contractar i no hi ha informaci\u00f3 clara i comprensible sobre el cost comparatiu amb altres modalitats de pr\u00e9stec de la mateixa entitat.<\/li>\n<li>La nul\u00b7litat de la cl\u00e0usula s\u00f2l no comporta, per\u00f2, la nul\u00b7litat dels contractes en els que s&#8217;insereixen, quedant la resta es inalterades.<\/li>\n<\/ul>\n<h3>Quines quantitats puc reclamar?<\/h3>\n<p>La sent\u00e8ncia referida declarava efectes restitutoris de les quantitats ja abonades de les cl\u00e0usules declarades nul\u00b7les, a partir del 9 de maig de 2013.<\/p>\n<p>No obstant aix\u00f2, a partir de la STS de 15 de febrer de 2017 i aplicant la sent\u00e8ncia del Tribunal Just\u00edcia de la UE de desembre de 2016, s&#8217;obliga per primera vegada a restituir per una cl\u00e0usula abusiva <strong> no nom\u00e9s les quantitats posteriors a 9 de maig sin\u00f3 les resultants des de l&#8217;inici del contracte.<\/strong><\/p>\n<h3>Qui ha de pagar les costes de la reclamaci\u00f3 de la cl\u00e0usula s\u00f2l de la meva hipoteca?<\/h3>\n<p>El 4 de juliol de 2017 La Sala Civil del Tribunal Suprem ha fallat que, amb criteri general, <strong> la banca haur\u00e0 de pagar les costes de tots els proc\u00e9s en qu\u00e8 sigui condemnada per aplicaci\u00f3 de cl\u00e0usules s\u00f2l abusives.<\/strong><\/p>\n<h3>Quins passos he de fer per reclamar el pagament de la cl\u00e0usula s\u00f2l de la meva hipoteca?<\/h3>\n<p>Per revisar si es donen els requisits necessaris per a la viabilitat de la reclamaci\u00f3, cal <strong> revisar l&#8217;escriptura del pr\u00e9stec hipotecari i altra documentaci\u00f3 facilitada per l&#8217;entitat banc\u00e0ria en el moment de la signatura de l&#8217;operaci\u00f3.<\/strong><\/p>\n<h3>Suposa algun canvi en els futurs pagaments de la meva hipoteca?<\/h3>\n<p>Les conseq\u00fc\u00e8ncies de l&#8217;\u00e8xit de la reclamaci\u00f3 judicial de la nul\u00b7litat de la cl\u00e0usula s\u00f2l comporta la <strong> supressi\u00f3 de la cl\u00e0usula s\u00f2l per al futur.<\/strong> Aix\u00f2 vol dir que<strong>\u00a0la quota hipotec\u00e0ria pot canviar substancialment.<\/strong> Tamb\u00e9 comportar\u00e0 la restituci\u00f3 de les quantitats abonades per l&#8217;aplicaci\u00f3 de la cl\u00e0usula abusiva de s\u00f2l des de l&#8217;inici del contracte.
