Adoptar unilateralment la data de GAUDEIXI de les vacances \u00e9s causa d&#8217;acomiadament del treballador;<br \/>\n&#8211; si desacord: procediment especial en la jurisdicci\u00f3 social;<br \/>\n&#8211; publicaci\u00f3 del calendari de vacances del treballador, almenys, 2 mesos abans del seu comen\u00e7ament.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table class=\"ms-rteTable-4\" width=\"100%\" cellspacing=\"0\">\n<tbody>\n<tr class=\"ms-rteTableHeaderRow-4\">\n<th class=\"ms-rteTableHeaderEvenCol-4\" colspan=\"1\" rowspan=\"1\"><strong>\u200bGaudi<\/strong><\/th>\n<\/tr>\n<tr class=\"ms-rteTableOddRow-4\">\n<td class=\"ms-rteTableEvenCol-4\">&#8211; A la data fixada, dins de l&#8217;any natural;<br \/>\n&#8211; en una altra fech a, fins i tot fora de l&#8217;any natural, si coincideixen amb:<br \/>\nIT, l\u00edmit 18 mesos seg\u00fcents a la fi de l&#8217;any;<br \/>\nIT derivada de l&#8217;embar\u00e0s, el part o la lact\u00e0ncia natural;<br \/>\nperm\u00eds per maternitat o paternitat.<br \/>\n&#8211; no substitu\u00efble per retribuci\u00f3 (2).<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table class=\"ms-rteTable-4\" width=\"100%\" cellspacing=\"0\">\n<tbody>\n<tr class=\"ms-rteTableHeaderRow-4\">\n<th class=\"ms-rteTableHeaderEvenCol-4\" colspan=\"1\" rowspan=\"1\"><strong>Infraccions \u200bi sancions<\/strong><\/th>\n<\/tr>\n<tr class=\"ms-rteTableOddRow-4\">\n<td class=\"ms-rteTableEvenCol-4\">&#8211; Transgressi\u00f3 de normes i l\u00edmits legals o pactats: greu;<br \/>\n&#8211; multa de 626-6250 \u20ac.<\/td>\n<\/tr>\n<tr class=\"ms-rteTableEvenRow-4\">\n<td class=\"ms-rteTableEvenCol-4\"><em>(1) Mateix nombre de dies per a treball a temps parcial o reducci\u00f3 de jornada.<\/em><br \/>\n<em>(2) Excepci\u00f3: extinci\u00f3 del contracte sense esgotar les vacances, i contracte eventual o de temporada.<\/em><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>&nbsp;<\/p>\n<\/div>\n<\/div>\n<h3>\u00bfQu\u00e8 diu la llei al respecte d&#8217;un treballador que fa les seves vacances sense pactar??<\/h3>\n<p>De forma molt resumida, la legislaci\u00f3 laboral indica que:<\/p>\n<ul>\n<li>Les vacances s&#8217;han de fixar de com\u00fa acord entre l&#8217;empresa i els treballadors.<\/li>\n<li>Si l&#8217;acord no existeix ni tampoc hi ha una concessi\u00f3 t\u00e0cita per part de l&#8217;empresa i, tot i aix\u00ed, el treballador s&#8217;absenta del seu lloc, estar\u00e0 incorrent en faltes repetides i injustificades d&#8217;assist\u00e8ncia a la feina.<\/li>\n<\/ul>\n<h3>Cas pr\u00e0ctic<\/h3>\n<p>Un treballador va comunicar a l&#8217;empresa que s&#8217;anava a agafar uns dies de vacances, per\u00f2 aquesta no els va concedir, com es va absentar igualment del seu lloc, va ser acomiadat i aquest acomiadament s&#8217;ha declarat procedent:<br \/>\nSi un empleat pensa que t\u00e9 dret a gaudir de vacances i l&#8217;empresa no se les concedeix, ha d&#8217;acudir al procediment judicial especial previst per a aquests casos. <strong>Atenci\u00f3!
