{"id":3751,"date":"2020-04-02T09:14:12","date_gmt":"2020-04-02T08:14:12","guid":{"rendered":"https:\/\/www.santcugatconsulting.com\/?p=3751"},"modified":"2020-04-01T23:11:56","modified_gmt":"2020-04-01T22:11:56","slug":"prohibicio-danar-a-treballar-per-a-serveis-no-essencials","status":"publish","type":"post","link":"https:\/\/santcugatconsulting.com\/ca\/prohibicio-danar-a-treballar-per-a-serveis-no-essencials\/","title":{"rendered":"Prohibici\u00f3 d&#8217;anar a treballar per a serveis no essencials"},"content":{"rendered":"<p>El passat diumenge el consell de ministres va aprovar el <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2020-4166\"><strong>Reial decret-llei 10\/2020<\/strong><\/a> que estableix un perm\u00eds retribu\u00eft obligatori i recuperable per a aquells empleats que treballin en sectors considerats com a serveis no essencials. <!--more--><\/p>\n<h4><strong>A qui afecta el perm\u00eds retribu\u00eft obligatori?<\/strong><\/h4>\n<p>A tots aquells treballadors assalariats que presten serveis en aquelles empreses i que no desenvolupen activitats considerades com a essencials i l\u2019activitat de la qual no hagi estat paralitzada per la declaraci\u00f3 de l\u2019Estat d\u2019alarma del passat 14 de mar\u00e7. Per tant, els aut\u00f2noms no es veuen afectats per aquest decret i podran continuar desenvolupant la seva activitat.<\/p>\n<h4><strong>Quines s\u00f3n les activitats considerades com a essencials?<\/strong><\/h4>\n<p>El Reial Decret ha fixat un total de 25 activitats que han quedat excloses del perm\u00eds retribu\u00efble. Entre elles trobem aquelles que treballen en la distribuci\u00f3 i entrega de productes adquirits en el comer\u00e7 per internet, les que presten serveis d\u2019entrega a domicili i les que treballen en les activitats que participen en la cadena d\u2019abastiment del mercat entre d\u2019altres. Adjunt a la present circular trobaran el <a href=\"https:\/\/santcugatconsulting.com\/wp-content\/uploads\/2020\/04\/LLISTAT-ACTIVITATS-EXCLOSES.pdf\">llistat complet de les 25 activitats que han estat considerades com a essencials.<strong>\u00a0<\/strong><\/a><\/p>\n<h4><strong>Com afecta a les empreses que han aplicat un ERTO?<\/strong><\/h4>\n<p>Aquest nou reial decret no ser\u00e0 d\u2019aplicaci\u00f3 per part de les empreses que estiguin aplicant o sol\u00b7licitin un ERTO. No obstant, les empreses que nom\u00e9s hagin redu\u00eft un percentatge de l\u2019activitat amb la tramitaci\u00f3 del corresponent ERTO podran compatibilitzar ambdues mesures. Aix\u00ed mateix, el nou Reial Decret no impedeix que les empreses que ho considerin puguin sol\u00b7licitar un ERTO.<\/p>\n<h4><strong>A qui no es pot aplicar el perm\u00eds retribu\u00eft?<\/strong><\/h4>\n<p>A les persones que es trobin de baixa per incapacitat temporal o el contracte del qual es trobi susp\u00e8s per altres causes. Tampoc es podr\u00e0 aplicar aquells per als que sigui possible el desenvolupament de l\u2019activitat en la modalitat de treball a dist\u00e0ncia.<\/p>\n<h4><strong>En quin per\u00edode s\u2019aplicar\u00e0 el perm\u00eds retribu\u00eft?<\/strong><\/h4>\n<p>Comprendr\u00e0 des de el dilluns 30 de mar\u00e7 fins al dijous 9 d\u2019abril de 2020 ambd\u00f3s inclosos.<\/p>\n<h4><strong>Com s\u2019aplica el perm\u00eds retribu\u00eft?<\/strong><\/h4>\n<p>Durant el per\u00edode de temps referit, les persones treballadores afectades quedaran exonerades de prestar els seus serveis tot i que conservaran el dret a la retribuci\u00f3 que els hagu\u00e9s correspost d\u2019estar prestant els serveis amb car\u00e0cter ordinari, incloent salari base i complement salarials.<\/p>\n<h4><strong>Com es recuperaran les hores no treballades?<\/strong><\/h4>\n<p>Una vegada finalitzat el per\u00edode referit, l\u2019empresa i la representaci\u00f3 dels treballadors hauran de negociar amb l\u2019objectiu de regular el sistema de recuperaci\u00f3 de les hores de treball no prestades. Aquest per\u00edode de consultes tindr\u00e0 una duraci\u00f3 m\u00e0xima de set dies i la recuperaci\u00f3 d\u2019hores es podr\u00e0 fer efectiva des de el dia seg\u00fcent a la finalitzaci\u00f3 de l\u2019Estat d\u2019alarma fins al 31 de desembre de 2020.<strong>\u00a0<\/strong><\/p>\n<h4><strong>Hi ha la possibilitat de mantenir una activitat m\u00ednima?<\/strong><\/h4>\n<p>S\u00ed, les empreses que hagin d\u2019aplicar el perm\u00eds retribu\u00efble podran, en cas de ser necessari, establir el n\u00famero m\u00ednim de plantilla o els torns de treball estrictament imprescindibles amb la finalitat de mantenir l\u2019activitat indispensable. Aquesta activitat i aquest m\u00ednim de plantilla o torns tindr\u00e0 com a refer\u00e8ncia la mantinguda a un cap de setmana ordinari o en festius.<\/p>\n<h4><strong>Les persones que segueixin acudint al centre de treball han de portar algun document?<\/strong><\/h4>\n<p>S\u00ed, s\u2019ha elaborat un model de declaraci\u00f3 responsable que hauran d\u2019emetre les empreses en el que s\u2019indica que la persona treballadora portadora del mateix pot continuar realitzant despla\u00e7aments al seu lloc de treball.
