{"id":891,"date":"2013-06-18T12:09:41","date_gmt":"2013-06-18T12:09:41","guid":{"rendered":"http:\/\/www.santcugatconsulting.com\/pensio-de-jubilacio-2\/"},"modified":"2014-10-13T07:42:03","modified_gmt":"2014-10-13T07:42:03","slug":"pensio-de-jubilacio-2","status":"publish","type":"post","link":"https:\/\/santcugatconsulting.com\/ca\/pensio-de-jubilacio-2\/","title":{"rendered":"Pensi\u00f3 de Jubilaci\u00f3"},"content":{"rendered":"<p>La nova regulaci\u00f3 recentment aprovada pel Reial decret llei 5\/ 2013 pret\u00e9n vincular l&#8217;edat de jubilaci\u00f3 als augments de l&#8217;esperan\u00e7a de vida , racionalitzar l&#8217;acc\u00e9s als plans de jubilaci\u00f3 anticipada i afavorir la prolongaci\u00f3 de la vida laboral .<\/p>\n<p><!--more--><\/p>\n<p>Les novetats m\u00e9s destacades s\u00f3n:<\/p>\n<p><span style=\"text-decoration: underline;\">Jubilaci\u00f3 parcial<\/span><\/p>\n<ul>\n<li>Reducci\u00f3 de jornada entre un 25 i un 50 %.<\/li>\n<li>Haver complert l&#8217;edat de <strong>61 anys com a m\u00ednim el 2013<\/strong> , edat que s&#8217;incrementa anualment fins al 2027 fins als 63\/65 segons els anys cotitzats .<\/li>\n<li><strong>Celebrar un contracte de relleu<\/strong> de durada igual al temps que li falti al treballador substitu\u00eft per assolir l&#8217;edat legal de jubilaci\u00f3 ordin\u00e0ria .<\/li>\n<li><strong>Una antiguitat en l&#8217; empresa d&#8217;almenys 6 anys<\/strong> immediatament anteriors a la data de la jubilaci\u00f3 parcial .<\/li>\n<li><strong>Si el rellevista \u00e9s contractat a jornada completa i de forma indefinida , la reducci\u00f3 pot arribar fins al 75 per cent .<\/strong><\/li>\n<li>Acreditar 33 anys de cotitzaci\u00f3 a la data de la jubilaci\u00f3 parcial .<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"text-decoration: underline;\">Possibilitat de compatibilitzar la pensi\u00f3 i el treball<\/span><\/p>\n<ul>\n<li><strong>Les persones que es jubilin ,<\/strong> tant si treballen per compte d&#8217;altri com a pr\u00f2pia ,<strong> podran compatibilitzar la pensi\u00f3 i continuar treballant ,<\/strong> sempre que acumulin tants <strong>anys cotitzats<\/strong> durant la seva vida laboral com per no tenir cap coeficient reductor per a aquesta mat\u00e8ria , actualment <strong>35 anys .<\/strong><\/li>\n<li>El treball compatible pot ser <strong>a temps complet ia temps parcial .<\/strong><\/li>\n<li><strong>La pensi\u00f3 que correspongui inicialment es reduir\u00e0 al 50%<\/strong> i s&#8217;exclou els complements a m\u00ednims .<\/li>\n<li><strong>Cotitzaran nom\u00e9s per les prestacions d&#8217;IT i conting\u00e8ncies professionals .<\/strong><\/li>\n<li><strong>Tindran la consideraci\u00f3 de pensionistes .<\/strong><\/li>\n<li><strong>Les aportacions<\/strong> que realitzin en aquesta situaci\u00f3 <strong>no milloraran la seva pensi\u00f3 .<\/strong> Quan deixin de treballar percebran de nou <strong>la pensi\u00f3 reconeguda inicialment .<\/strong><\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\"><br \/>\nJubilaci\u00f3 anticipada for\u00e7osa<\/span><\/p>\n<ul>\n<li><strong>L&#8217;edat m\u00ednima<\/strong> per acollir-se a la jubilaci\u00f3 anticipada for\u00e7osa <strong>ser\u00e0 quatre anys abans de complir l&#8217;edat legal<\/strong> que en cada cas sigui aplicable .<\/li>\n<li>Hi ha d&#8217;haver cotitzat un per\u00edode<strong> m\u00ednim de 33 anys .<\/strong><\/li>\n<li>Han d&#8217;estar <strong>inscrits en l&#8217;oficina d&#8217;ocupaci\u00f3<\/strong> , almenys sis mesos abans de la sol \u00b7 licitud de la pensi\u00f3 .<\/li>\n<li>El cessament en el treball ha d&#8217;haver estat motivat per alguna de les causes seg\u00fcents :<\/li>\n<li><strong>Acomiadament col \u00b7 lectiu ,<\/strong> art .51 E.T.\n<ul>\n<li>Acomiadament objectiu , art . 52 , apartat c ) E.T.<\/li>\n<li>L&#8217;extinci\u00f3 del contracte en empreses en concurs Art.64 , Llei 22 \/2003, de 9 de juliol .<\/li>\n<li>Mort , jubilaci\u00f3 o incapacitat de l&#8217; empresari individual o extinci\u00f3 de la personalitat jur\u00eddica del contractant .<\/li>\n<li>Extinci\u00f3 del contracte per causa de for\u00e7a major .
